What is TM Opposition?
Trademark opposition is the post-publication proceeding in which a third party objects to registration of an advertised mark, usually on the ground that it is identical or deceptively similar to the opponent’s earlier mark or is otherwise barred by the Act. It is a contested proceeding before the Registrar with pleadings (notice of opposition and counter-statement), evidence by affidavit and a hearing, ending in an order.
The Registrar can reject the opposition, partly accept it by restricting goods or services, or refuse the application. Any person can oppose, though in practice the opponent is usually the owner of an earlier right.
