Patent Registration

A patent in India is granted under the Patents Act, 1970 (as amended) and the Patents Rules, 2003 by the Patent Office under the CGPDTM. The applicant files Form 1 with a provisional or complete specification (Form 2). The application is published after 18 months, examination starts only after a Request for Examination (Form 18), and a grant gives a 20-year term from the filing date. The process usually takes two to four years, and expedited examination (Form 18A) is available to startups, small entities and certain other applicants.

Service Overview

What is Patent Registration?

A patent is a statutory exclusive right granted for an invention, which is a new product or process involving an inventive step and capable of industrial application under Section 2(1)(j). It lets the patentee prevent others from making, using, selling or importing the invention in India without consent for 20 years from the filing date, in exchange for full public disclosure.

Certain subject matter is excluded under Section 3, for example mere discoveries. A provisional specification secures the priority date, and the complete specification must follow within 12 months. After publication at 18 months, the applicant must request examination, after which the examiner issues the First Examination Report; replies are typically allowed for about six months.

Who Needs This Service

Inventors, R&D-driven companies, startups with novel products or processes, universities and research institutions, and manufacturers developing new technology need patents. Deep-tech and pharma companies depend on them to protect investments.

Because novelty is essential, inventors should avoid public disclosure before filing at least a provisional application.

Startups may qualify for reduced fees and expedited examination, and should check eligibility.

If your innovation is a product's appearance rather than technical, consider a design registration; if it is a brand, a trademark.

  • Search, drafting and filing support
  • Provisional filing to secure priority
