TM Application Filing

The trademark application is filed in Form TM-A on the IP India e-filing portal, or physically at one of the five Trade Marks Registry offices at Mumbai, Delhi, Kolkata, Chennai or Ahmedabad, with the fee per class. After filing, an application number is generated and the Registry begins its formalities check and examination. E-filing fee is Rs 4,500 per class for individuals, startups and small enterprises and Rs 9,000 per class for others.

What is TM Application Filing?

Trademark application filing is the formal submission of Form TM-A to the Trade Marks Registry requesting registration of a mark for specified goods or services. The date of filing fixes the applicant’s priority, and the 10-year term runs from that date. The application can be for a mark already in use, with a user date, or for a mark proposed to be used.

One application covers one mark and can cover multiple classes, with the fee payable for each class. The Registry office is determined by the applicant’s principal place of business, with five offices serving different regions. The mark must be capable of distinguishing goods or services and not fall under Sections 9 or 11.

TM Application Filing

Who Needs This Service

Brand owners, startups, MSMEs and agents or attorneys filing on behalf of clients need to file applications. Businesses that have chosen a name and are about to launch should file at once.

Companies that have been using a mark for some time without registration should file with the user date to establish priority.

If you have several brands or product lines, plan classes carefully so that each important mark is protected where it matters most.

Applicants who want to claim reduced fees should prepare their Udyam or startup certificate in advance.

Key Benefits

  • Correct class selection and description of goods or services
  • TM-48 and mark representation prepared properly
  • Reduced fee claimed where eligible
  • Filing receipt and application number delivered quickly
  • Lower risk of formality check failure

Next Steps & Related Services

After filing, track the status and be ready to respond to formality or examination reports.

Related services: TM Search, Formality Check Fail, TM Objection, TM Hearing and Trademark Registration.

Common Mistakes

  • Filing in the wrong class.
  • Poor logo quality or format.
  • Not signing TM-48 properly.
  • Choosing a description that is too narrow.
  • Missing the formality fail deadline.

Timeline, Costs & Practical Tips

Filing itself can be done within a day once documents are ready.

Practical tip: keep your logo in the required format, the proposed classes and goods and services list, and applicant details ready so that the application can be filed without delay.

Additional Information

Under the Trade Marks Rules, 2017, applications are made in prescribed forms with prescribed fees. Filing establishes the priority date, which matters in disputes over who first claimed the mark.

Practical Scenarios

Scenario 1:

A startup files a TM-A for its brand name and logo in two classes.

Scenario 2:

A family business that has used a name for years files with a user date.

Scenario 3:

A small enterprise claims the concessional fee by attaching its Udyam certificate.

Practical Guidance

The most common cause of avoidable delay in trademark applications is the application itself: wrong class, a poorly described list of goods or services, or an invalid authorisation. Treat the filing as a drafting exercise. Describe goods and services precisely enough to cover your business and expansion plans, but not so broadly that you invite objections. Choose classes based on what you sell today and what you expect to sell in the next few years, and keep your user date evidence handy if you claim prior use. Once filed, monitor the status regularly so that formality notices and examination reports are answered inside the time limits.
