What is Legal Agreement?
A legal agreement is a written understanding between two or more parties that creates rights and obligations. Under Section 2(h) of the Indian Contract Act, 1872, an agreement enforceable by law is a contract. To be enforceable it must satisfy Section 10: offer and acceptance, free consent of competent parties, lawful consideration and lawful object. Section 11 requires parties to be of the age of majority and of sound mind, and Section 23 declares agreements with unlawful objects void.
Electronic contracts have the same legal effect as paper contracts under the IT Act, 2000 and the Evidence Act, 1872. The Contract Act does not require writing or registration, but other laws do: stamp duty under the Indian Stamp Act, 1899 and state laws, and registration under Section 17 of the Registration Act, 1908 for certain documents such as some immovable property transactions.
