What is Formality Check Fail?
Formality check is the Registry’s preliminary administrative screening of a trademark application before examination on merits. A ‘Formality Check Fail’ means the application, representation, fee or supporting documents did not meet the formal requirements, and the Registry issues a notice describing the defect. Passing the formality check moves the application to substantive examination.
Typical defects include missing or improperly executed Form TM-48 (power of attorney), absence of translation or transliteration certificates for non-English marks, missing user affidavit, errors in applicant details or identity documents, unclear logo files, incorrect goods and services description and class errors.
